3. User Accounts

5. Speaking Practice and Voice Data
a. When you use speaking practice features, your voice is recorded and processed by AI services for feedback.
b. Voice recordings are processed in real-time to provide pronunciation feedback and conversation responses.
c. We do not permanently store voice recordings unless required for specific features you opt into.
d. You are responsible for ensuring your speaking practice occurs in appropriate environments.

6. Learning Content and Materials
a. All lessons, audio content, flashcards, and learning materials are the intellectual property of SpeakWiz.
b. Content is licensed for personal, non-commercial use only.
c. You may not copy, distribute, or sell any content from the app.
d. AI-generated responses and personalized content are provided for your learning purposes only.

7. Subscriptions and Billing
a. Certain features may be available only with a paid subscription.
b. Payments are securely processed via your app store provider (Apple/Google).
c. Subscriptions auto-renew unless canceled before the end of the billing cycle.
d. You may cancel anytime via your app store settings.
e. Subscription fees are non-refundable except where required by law or due to technical error.
f. Free trial periods, if offered, will convert to paid subscriptions unless canceled before the trial ends.

8. Intellectual Property
The SpeakWiz brand, app design, lesson content, audio materials, and AI-powered features are the intellectual property of SpeakWiz and its licensors. You may not copy, modify, or distribute our content without permission.

9. User-Generated Content
a. Flashcards you create and notes you take remain your property.
b. By using the Service, you grant us a license to process your content to provide the Service.
c. You are responsible for any content you create within the app.

10. App Availability
We strive to keep SpeakWiz available at all times but cannot guarantee uninterrupted access. Downtime may occur due to:
a. Scheduled maintenance
b. Third-party outages (including AI service providers)
c. Technical issues
d. Force majeure events

11. Termination
We may suspend or terminate your access to the Service at any time for violating these Terms. Upon termination:
a. Your subscription will be canceled.
b. Your learning data may be deleted after a reasonable period.
c. Terms related to liability and intellectual property will continue to apply.

12. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee:
a. That you will achieve any specific level of Spanish fluency
b. That AI feedback or pronunciation assessments are always accurate
c. That the app is always error-free or uninterrupted
d. That learning timelines mentioned in marketing materials apply to all users

Individual results vary based on effort, consistency, and prior knowledge.

13. Limitation of Liability
To the extent allowed by law, SpeakWiz is not liable for:
a. Loss of learning progress or data on your device
b. Inaccurate AI feedback or lesson content
c. Any outcomes resulting from reliance on the Service
d. Indirect or consequential damages

Our total liability is limited to the amount you paid for the Service in the last 12 months.

14. Governing Law
These Terms are governed by the laws of the United States. Any legal disputes will be resolved in the courts of the United States.

15. Changes to Terms
We may update these Terms from time to time. If changes are material, we'll notify you via the app or email at least 30 days in advance. Continued use of the Service means you accept the new Terms.
